Most adult-site terms of service run to 12,000 words of boilerplate built to hide liability, scare readers out of quoting, and reserve rights the publisher will never actually use. This page is shorter, structured by what you actually need to know, and honest about the 18+ requirement up front. I wrote it the way I'd want a reader contract written to me.

bestgirlfriend.ai (the "Site") is an independent editorial comparator covering AI girlfriend apps, live cam sites, and adult games. It does not offer chat, AI generation, live video, or any payment flow on its own domain. These Terms (the "Terms") describe the reader contract between you and the publisher of the Site, drafted against the U.S. Restatement (Second) of Contracts, EU Directive 2011/83/EU and 2019/770, the UK Consumer Rights Act 2015, the Canadian Competition Act, and the Australian Consumer Law. Where any clause conflicts with a mandatory provision of those statutes in your jurisdiction, the statute prevails.

Who can use bestgirlfriend.ai?

Any adult of legal majority in their jurisdiction may read the Site (18+ in most regions, higher in some U.S. states and Asian markets). Minors are categorically prohibited. The Site is editorial only, so use does not require account creation, payment, or identity verification on our domain.

The Site is published from the European Union and accessible globally. We rely on each reader to confirm their own legal majority. Where a national or sub-national authority imposes a higher threshold or an age-assurance requirement (Texas HB 1181, Utah SB 287, Louisiana Act 440, the UK Online Safety Act 2023, the EU Digital Services Act), readers are routed through our age-verification page before suggestive imagery or any affiliate path is exposed.

What conduct is prohibited?

Industrial scraping, evading rate limits, reverse-engineering our scoring, framing or hot-linking our content, impersonating Alexandra Joly or the editorial team, posting unlawful content via /contact, and any attempt to interfere with Site availability. Personal reading, sharing a link, and quoting with attribution are expressly permitted.

The prohibited list is narrow on purpose. We want our content to circulate, so quotations on Reddit, in newsletters, and in academic citations are all welcome. What we don't want is wholesale extraction of the proprietary benchmark dataset, mass-translation farms cloning our structure, or automated crawlers ignoring the crawler directives we publish. Those behaviours trip Cloudflare security rules and, in extreme cases, the civil remedies described under "What happens if I violate these terms?" below.

Short quotations with a visible byline credit and a do-follow link to the source page are permitted under fair use, fair dealing (UK, CA, AU), and the EU quotation right (Directive 2001/29/EC, Article 5). A "short quotation" means up to ≈ 150 words from a single page, used for commentary, criticism, news reporting, teaching, or research, with an unobscured do-follow hyperlink to the source URL. AI-derived paraphrases count as derivative works no matter how deep the paraphrase goes; the test is whether the copy substitutes for the original, not how much wording overlaps. Academic researchers and journalists on deadline can request expedited written permission, typically answered within 48 hours.

Are there any user accounts?

No. bestgirlfriend.ai does not offer reader accounts, subscriptions, paywalls, or login flows on its own domain. The newsletter and the Discord community are optional, governed by their own terms, and never required to read editorial content. Affiliate signups happen on third-party platforms under their own contracts.

The absence of accounts is deliberate. No login means no password breach risk, no profile graph to leak, and no behavioural cookie pool for anyone to subpoena. The newsletter and Discord are opt-in extensions with their own terms, and you can leave, block, or unsubscribe from either without losing access to any review on the Site.

What if a third-party platform misleads me?

Disputes about a platform's pricing, billing, or service quality are between you and that platform, not us. Our review is editorial commentary based on standardized testing, not a guarantee of the platform's conduct. We log substantiated complaints in the errata board and re-test under our published cadence.

We describe what we observed during testing and what user reports add up to. We can't underwrite a third party's billing rails or refund flow. Copyright sits with the publisher. Trademarks stay with their proprietors, and our use is strictly nominative: we name a platform to describe and evaluate it, never to imply approval or sponsorship. The Alexandra Joly persona, visual identity, and proprietary scoring criteria are protected as a coherent editorial asset under EU, U.S., UK, Canadian, and Australian copyright and trademark frameworks.

What happens if I violate these terms?

We may revoke your access by IP, ASN, or Cloudflare rule, without notice, for any material breach (industrial scraping, rate-limit evasion, abusive contact). Civil remedies, including damages and injunctive relief, remain available under applicable law. We have never pursued a reader for ordinary reading or quoting and do not intend to start.

The escalation ladder is graduated. The first responses are technical: a rate-limit, a captcha, a security rule. If that doesn't stop the abuse, the next step is administrative, a cease-and-desist to the operator's hosting provider or registered agent. Only material commercial harm gets us to civil action under copyright, trademark, and unfair-competition law. Ordinary readers, quoters, and link-sharers will never see this ladder activated.

Are there any warranties?

No. The Site is provided AS-IS, without warranty of any kind, express or implied. We make no warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The cap is not a trick. It mirrors what you actually pay us, which is nothing. We earn from affiliate commissions paid by third-party platforms downstream of an outbound click, not from readers. EU readers keep their mandatory remedies under Directive 2011/83/EU; UK readers under the Consumer Rights Act 2015 fairness test; U.S. readers under state UDAP statutes. A cap clause never waives a non-waivable statutory right.

Do I indemnify you?

Only for your own misuse of the Site. You agree to hold bestgirlfriend.ai and its editorial team harmless from third-party claims arising directly from your industrial scraping, impersonation, unlawful content submission, or other prohibited conduct. Ordinary reading and quoting carry no indemnification obligation.

Indemnity is the boring mirror image of the prohibited-uses list above. If you scrape us at industrial volume and your hosting provider sues us because the abuse trail leads back to your infrastructure, you cover the legal costs, not us. If you read us, quote us, or share a link with a friend, this clause never activates.

How does the affiliate revenue model affect these terms?

It does not change your rights or obligations as a reader. The affiliate disclosure explains how we earn; our scoring page explains how we score; this Terms page governs your interaction with the Site itself. Clicking an affiliate link transfers you to a third-party platform whose own terms then apply.

The three documents are layered. Terms of Service governs reading the Site. Affiliate Disclosure is the FTC-compliant statement of how the publisher earns. Affiliate revenue doesn't buy editorial favour, our editorial choices don't bind the affiliate networks, and these Terms don't reach the platforms downstream of an outbound link.

These Terms are governed by EU law and France for EU readers, U.S. federal law and the State of Delaware for U.S. readers, and the consumer-protection statutes of your country of residence where mandatory rules apply. This is a layered choice-of-law clause, drafted to satisfy the Rome I Regulation Article 6 (consumer contracts, EU) and Restatement (Second) Conflict of Laws §187 (U.S.). The underlying principle is the same on both sides of the Atlantic: a publisher can't waive your mandatory consumer rights by contract, whatever the forum. How do I resolve a dispute?

The dispute ladder is short on purpose and front-loaded toward direct resolution. Most contestations (a wrong score on a sub-criterion, an outdated pricing snapshot, a missing feature) get resolved by editing the page and logging the change in the errata board. We don't silently amend these Terms. Every substantive edit is dated, reflected in the page's revision date, and previewed to newsletter subscribers. Cosmetic edits (a typo fix, a broken link repair, a formatting cleanup) get logged with a "non-substantive" flag. What if a clause is unenforceable?

If any clause is held unenforceable by a competent court, that clause is severed and the remainder of the Terms continues in force. The severed clause is replaced by the closest lawful equivalent that preserves the original intent. Severability is standard practice and is itself permitted under EU, UK, U.S., Canadian, and Australian contract law.

Severability isn't a loophole, it's housekeeping. Consumer-protection regulators occasionally strike down boilerplate clauses (forum-selection, class-action waivers, broad limitation-of-liability), and we'd rather lose one paragraph than collapse the whole contract. Clauses that have already failed elsewhere in the consumer-contract case law we follow are trimmed out of this draft before they ever ship.

Is this the entire agreement?

Yes. These Terms, together with the Privacy Policy, Cookies notice, DMCA procedure, and Affiliate Disclosure, constitute the entire agreement between you and bestgirlfriend.ai regarding your use of the Site. Earlier drafts or marketing copy do not modify this agreement.

Side communications (email replies, Discord answers, social posts) can clarify but never amend the contract.
